PRIVACY POLICY
Welcome to the York Fit Finder web application (the “App”), owned and operated by York Athletics Manufacturing, Inc. (“we”, “us”, or “York”). This Privacy Policy (“Privacy Policy”) explains how York collects, uses and shares information about you when you use the App.
Please read this Privacy Policy carefully. When you download, install or use the App, you acknowledge that you have read, understood, and agree to be bound by the terms of this Privacy Policy and consent to York’s collection and use of personally identifiable information (“Personal Information”) and other information as set forth herein. If you do not consent to the terms of this Privacy Policy, you should not access or use the App in any way and should immediately exit the App.
Collection of Information
Personal Information: If you desire to access or use the App, you may be required submit certain Personal Information and other information to York, including your name, email address, password, gender, shoe size, and whether or not you are from the United States. By using the App, you may also choose to create an account and/or provide York with certain Personal Information or other information about yourself. Under no circumstances should you provide your social security number, driver’s license number, credit card or banking account information, or other sensitive Personal Information through the App.
Use Data: By choosing to use the App, you agree to provide York with certain information that is automatically created, collected, and recorded by your use of the App (“Use Data”). This Use Data may include information such as your operating system version and type, current IP address, geographic location, and information about your usage of the App. York uses third-party analysis software tools (the “Tools”), such as “cookies,” web server logs, and analysis software (including Google Analytics and Hotjar) to gather Use Data. Cookies are small pieces of data that are stored on your hard drive. The Tools may be used by York to, among other things, collect technical statistics regarding use of the App. Use Data is collected on an aggregate basis and does not consist of any Personal Information.
Use of Information
York uses your information, including Personal Information, for various purposes in connection with its business, including, but not limited to, providing and managing services in connection with the App, providing customer service and support, responding to your inquiries and requests, providing you with information related to the App or that we otherwise believe will be of interest to you, and notifying you about certain changes to the App.
York uses Use Data in order to monitor use of the App and our services, for the App’s technical administration, and to improve the App and our services. We also use Use Data for marketing and analytics purposes, to conduct tracking and analytics, and to help us understand how people use the App.
Subscribing to E-mail Correspondence
We provide an opportunity for App users to subscribe to certain email newsletters, updates, or offers. In order to complete your request, we ask for your name and email address. We will not send you an email newsletter, update, or offer unless you first request it. If you provide us with your name and email address, we will use your email address to respond to your inquiries, requests or questions and to send you newsletters and other information. Except as specifically set forth in this Privacy Policy, we will not share or sell this information for marketing purposes. By providing York with your name and email address, you authorize York to send you regular emails unless and until you request to unsubscribe from such emails. Each email newsletter, update, or offer that we send to you will provide an opportunity to opt out of future email correspondence.
Sharing of Information
Service Providers: We engage certain trusted third parties to perform functions and provide services to us, including, without limitation, order fulfillment and logistics services, hosting and maintenance, database storage and management, data analysis, and legal, accounting, and/or marketing services. We may share your Personal Information or Use Data with these third parties, but only to the extent necessary to perform these functions and provide such services, and your Personal Information will only be shared pursuant to binding contractual obligations requiring third parties to maintain the privacy and security of your data.
Other Third Parties: We also may share, disclose, or transfer your Personal Information or Use Data with third parties as follows: (a) to government agencies, advisors and other third parties, where necessary and appropriate, in order to comply with applicable laws, the service of legal process, or if we reasonably believe that such action is necessary to (i) comply with the law requiring such disclosure, (ii) protect York’s rights or property, (iii) prevent a crime or protect national security or (iv) protect the personal safety of the users or the public; (b) if we believe your actions violate our Terms of Service or other policies; or (c) in connection with a financing or a sale, acquisition or merger of our business or our business assets. We may also share with others aggregated or anonymized information that does not directly identify you.
Third Party Sites or Apps
If you choose to make payment for products, we will direct you to Shopify, a third-party payment processor, to provide a credit card number and other personal data needed to complete the transaction. Our payment processor will be certified to meet the industry standards for security and confidentiality, as well as applicable laws. You may receive email correspondence from us and or the payment processor related to any online transaction.
The App may contain links to external websites or applications. Please note that this Privacy Policy applies only to the App, and not to third party websites or applications to which the App links. York is not responsible for the practices and policies (including privacy policies) of third parties and, therefore, you should review the privacy practices and policies of such third parties prior to providing your Personal Information in connection with such websites or applications.
Security
York uses reasonable care to protect the privacy and security of Personal Information and to ensure that our systems are secure and meet industry standards. Where appropriate, we employ encryption technology and user authentication systems (e.g., usernames and passwords) to control access to systems and data.
Unfortunately, no Internet transmission is ever completely secure, and we cannot guarantee that unauthorized access, hacking, data loss or other breaches will never occur. WE EXPRESSLY DISCLAIM ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO ANY BREACHES OF SECURITY, DAMAGE TO YOUR DEVICE, OR ANY LOSS OR UNAUTHORIZED USE OF YOUR PERSONAL INFORMATION OR OTHER DATA.
Unauthorized Use
Unauthorized attempts to use the App in a way that violates our Terms of Service, to utilize the App for other than its intended purposes, or to defeat or circumvent the App’s security features are strictly prohibited. We do not intend for the App to be used by children under the age of 13, nor do we seek to collect information about children under the age of 13. If you are under the age of 13, please do not provide us with any information and promptly exit the App.
Privacy Policy Updates
York may amend, update or modify the terms of this Privacy Policy at any time, by posting an amended Privacy Policy on York’s website, yorkathleticsmfg.com, or the App. If you do not consent to the terms of this Privacy Policy, as amended, you should not access or use the App in any way. By continuing to access or use the App after those changes become effective, you agree to be bound by the revised Privacy Policy.
